1. This User Agreement (hereinafter referred to as the ‘Agreement’) is entered into between Melino Turizm Seyahat A.Ş. (hereinafter referred to as ‘Melino Turizm’), a joint stock company established and existing under the laws of the Republic of Turkey, with tax identification number 6141416316 and headquartered at Çağlayan Mahallesi 2001 Sokak Şirin Apartmanı No:6/1 Muratpaşa/Antalya, and the user (hereinafter referred to as the ‘User’) of the website www.manageyourholiday.com (hereinafter referred to as the ‘Website’), for the user to use the website.

(Melino Tourism and the User will hereinafter be referred to as the ‘Parties’).

2. Definitions

In this Agreement;

- ‘Melino Turizm’ refers to Melino Turizm A.Ş. ‘Content’ refers to all kinds of information, files, pictures, figures, visual, literary and auditory images published or accessible on the Website,

- ‘User’ means all natural and legal persons who are competent to use civil rights to benefit from the contents, applications and services on the Website by accepting the terms of the Agreement,

- ‘Service’ means the agency service/services to be provided to the User by Melino Turizm within the scope of the Website,

- ‘Agreement’ means this User Agreement ,

- ‘Parties’, Melino Tourism and the User,

- ‘Website’ refers to the domain name www.manageyourholiday.com and other websites that can be accessed from other subdomains and where Melino Tourism provides agency services specified in the scope of the Agreement.

3. Subject and Scope of the Agreement

3.1 www.manageyourholiday.com reserves the right to change or revise these contract terms without giving any reason or warning. Users accept that they use the terms, conditions, information and technical specifications in the current publication of www.manageyourholiday.com.

3.2 This Agreement regulates the rights and obligations of Melino Turizm and the Users regarding the service to be provided to the User by Melino Turizm operating in the tourism sector. The User shall not proceed to the next steps without reading and approving the ‘User Agreement’ and ‘Privacy Policy’.

3.3 As soon as the User ticks the box ‘I have read and approve the User Agreement and Privacy Policy’ in the steps of receiving an offer, the Agreement is established and there are sections where the User will fill in the request, reservation, let us call you or your opinions forms. During the filling of these sections, users do not have the right to damage manageyourholiday.com or the legal and personal rights of others by using swearing, threats, provocation, disturbing words and illegal content. In addition, it is forbidden to copy and use these forms or use them as examples for reproduction. 4. Terms of Service Use

4.1 The person who wants to receive Services through the Website cannot have the right and authorisation to become a User defined in this contract without entering the requested information. Persons under 18 years of age or minors, restricted persons and those who do not have the power of appeal can only make transactions through their parents or legal representatives. 7. Force Majeure

Melino Turizm shall not be liable for late or incomplete performance or non-performance of any of its obligations under this Agreement in all cases deemed to be ‘force majeure’, including but not limited to cyber-attacks, natural disasters, riots, war, strikes, communication problems, infrastructure and internet failures, power outages and bad weather conditions, which are beyond the reasonable control of the relevant party, unforeseeable and unavoidable events that cannot be avoided despite due diligence. In case of force majeure, Melino Tourism shall not be entitled to any compensation under any name.

8. Other Provisions

8.1 If the provisions of this Agreement are violated, Melino Turizm may prevent the User from using the Website and/or may take all kinds of legal action against the User.

8.2 In any dispute arising from the use of the Website and the Service, Melino Turizm books and records, log records, computer records constitute conclusive and exclusive evidence within the framework of Article 193 of the Code of Civil Procedure No. 6100.

8.3 Melino Turizm may place links to third party websites within the Website. When you connect to these third party sites, you are deemed to be subject to the terms of use of the relevant site. Melino Turizm cannot be held responsible in any way for the content or privacy conditions published on these sites and for any direct and/or indirect damages that may arise from the use of these sites.

In addition, Melino Tourism does not guarantee the performance and reliability of the persons and organisations on third party websites. The fact that Melino Turizm links to these sites does not mean that Melino Turizm acts on behalf of third party sites, represents them, is their business partner or authorises them in any matter or acts on their behalf and account.
